Terms & Conditions for Booking Reels with Charlotte Bury Photography
The following terms and conditions apply to all bookings made via www.charlotteburyphotography.co.uk for reels and will form the basis of your contract with Charlotte Bury Photography.
- Age – We only accept bookings from persons over 18 years of age.
- Payment – Full payment is required when a confirmed booking is made. If payment is not received, footage may not be taken.
- Filming Location Disclaimer – In the event that the rider does not pass the location at which the videographer is stationed during their round, no refund or partial refund shall be issued.
- Re-Scheduling – Charlotte Bury Photography will always endeavour to re-schedule a booking if sufficient notice is given and availability allows. Re-scheduling is not guaranteed. If any changes occur to your booking, you must notify Charlotte Bury Photography in writing via text or email.
- Cancellation – If you wish to cancel your booking, please do so in writing via text or email. The date and time of the message will determine whether a refund is due. If you cancel more than 24 hours before your scheduled booking, you are entitled to a refund minus transaction charges, or to reschedule at no additional cost. Within 24 hours of the reel no refund will be given.
- Supply – Edited footage will be supplied within 72 hours of the booking sent to the email address provided by WeTransfer.
- Music – Charlotte Bury Photography cannot supply footage with copyright-protected music. All reels are delivered without sound, so the purchaser can add their own music when publishing to their chosen platform.
- Artistic Judgement – Charlotte Bury Photography retains full artistic control, including decisions regarding footage taken. All judgements related to location and extent of filming are final. Due to weather, access, or safety concerns, not all requested content may be captured.
- Copyright – The right of Charlotte Bury Photography to be identified as the author of the material/footage/film is asserted in accordance with the Copyright, Designs and Patents Act 1988.
- Display – All video material recorded and edited by Charlotte Bury Photography on behalf of clients may be used for marketing purposes including websites and social media platforms. Footage may also be shared on www.charlotteburyphotography.co.uk and our business Instagram page. Charlotte Bury Photography may also grant Wellington Riding access to all reels filmed at their events
- Loss of Data/Image Files – Charlotte Bury Photography is not responsible for loss of data or footage due to circumstances beyond our control.
- Force Majeure / Act of God – Performance of this contract is subject to alteration or cancellation due to any cause beyond either party’s control.
- Limitation of Liability – In the event of cancellation or any other issue, the liability of either party shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.
- Complaints – Any complaints must be submitted in writing to Charlotte Bury Photography within 28 days of becoming aware of the issue and no later than 28 days after receiving the footage.
- Agreement – By signing booking a reel, you agree to accept these terms. The person accepting these terms does so on behalf of all individuals included in the booking and ensures all are bound by them.
